: At what point do I seek legal advice if I wanted to trademark something- before or after I file for the trademark?? You cannot be expect to know the law and how to deal with a situation nor the options or choices and risks. This is where a lawyer is needed. A lawyer can help you know what you have and what you can do. You may also be made aware of other options that you hadn't though of. The filing of an application also involves costs, even if you try to do it yourself. There are often risks that are not visible to the unwary. It is like medicine you can't be expected to know how to diagnose, or find medical problems, let alone treat them. Not this doesn't mean that you are passive to the problem as to what it is and what and how you are going to act or how much it is going to cost. You need to find a practicioner that you can trust to help you do what you want to do. Do not start out without trust but in all events do not act until you feel satified that your interests are going to be properly taken care of. M.
