Re: Assigning patent to a company[ Follow Ups ] [ Post Followup ] [ Patent Forum ] [ FAQ ] Posted by Coulter Henry, Patent Agent on October 10, 2002 at 04:56:57: In Reply to: Assigning patent to a company posted by Tucker Cox on October 09, 2002 at 10:31:03: An assignment gives the an individual/company all rights to the invention. Normally under employee agreements signed upon hiring, the employEE agrees to assign any inventions to the company that were developed under company time or research. Sometimes a clause is put into company assignments that sell the invention to the company for one dollar. Therefore, the company "owns" the patent. Then the company can "license" the patent to outside parties. However, if an invention would be particularly lucrative for a company, the inventor can make further negotiations that will pay royalties from the sale of the product made from the invention. Normal assignments, meaning not under company control, can be made for monetary amounts. Hope this helps.
