If that statement is incorrect could I now claim it was a fraudulent use of my idea? Dear CA, If the patent is issued and you are listed as a coinventor, you must have signed the application. The odds are you also signed an assignment. The nature of your employment by may also be an issue. Did you have a written employment contract? Even if you have proof, can you afford to sue? It has been done, finding a lawyer to sue on a contingency for patent infringement, it's not easy. The statute of limitation may have also run. This is where Elaine's Worhshop® came from.
