When is it safe to file a patent after leaving employer?

Hello:

I have left my employer and am embarking on some research that may lead to a patent. The research is about one possible application of my ex-employer's technology. To the best of my knowledge, there are no plans within my ex-company for this sort of an application. And I am in California.

However, I'd like to leave nothing to chance. If this idea takes off, I am afraid that my ex-employer might try to claim that they were thinking of it, etc. and file suit. While they are honorable people, they are in the midst of dire financial straits, and there is no way to ensure that they won't do it.

The dilemma is that I need to at least file a provisional patent before I can go for funding. Once I have funding I can afford an IP lawyer.

So here's the question: what is the appropriate length of time between leaving and filing of provisional patent that is considered safe? Is it 3 months or 6 months or even longer? Much thanks.
