You can get a patent and have claims that are so weak that the idea can be used without infringing the patent you have. I had a recent inquiry where this happened. The client had a patent, obtained from a legitimate patent practicioner. The patent was probably valid but the claims were so limited that others could and were using the inventive idea without infringing the patent. Our Reality Check(sm) or a patent search, might have be able to warn the inventor that though the patent was available that the prospective cost and limited scope of protection may not have justified filing.
