: Can anyone patent a product in Canada that has only been patented in the USA or would this be construed as a patent infringement?
Only the inventor or assignee can file. If the US patent has issued even if filed by the proper party it might be too late to file in Canada. Filing would not be an infringment in Canada but might be a fraud.
