Dear Laura,

If there has been more than one year of public use, no valid patent can issue.

With or without a patent, if there is a market fot the product a trademark will identify you as the source and give an important commercial recognition. Remember Coca Cola.

Patents are good for 20 years from the date of filing. Trademarks are good forever, as long as they are in use.
