Another big problem is the statute of limitations, which is generally 6 years for patents. (There are two other time-limits in patents: laches and estoppel, which are tricky to explain.) Other time limits may apply, varying from state to state.

The bottom line is why did you wait so long to bring this up? If you have a strong enough reason, you may be able to overcome the time limit. Otherwise, it may be a non-starter.
