Check out the PTO website for a copy. These guidelines are based on several Federal Circuit decisions that lay out what's black, white and gray. See MicroChemical v. Great Plains Chem., 52 U.S.P.Q.2d 1258 (Fed. Cirl 1999); Al-Site v. VSI, 174 F.3d 1314, 50 U.S.P.Q.2d 1161 (Fed. Cir. 1999).
