Madden on March 22, 2001 at 15:19:39: Is there any case law on being able to separate the value of a patent (e.g., ability to charge monopoly rents, protection from infringement, exclusivity) from the value of the underlying technology (e.g., better mousetrap)? Everything that I can find out there treats the patent as the technology and the technology as the patent. As a follow-up question, would the value inherent in a patent be substantially different from the value of a trade secret?
