One must know the differences between trademark and trade name. Designs can be copyrighted. That doesn't stop similar designs on the market, as longs as they are not copies. A design patent may protect a very specific style. The problem is that the patent usually takes to long to issue to catch the market. Early legal advice is not expensive and could be valuable if you deal with a lawyer focued on the problem not just the fee. M. Arthur Auslander
