Patent infringement?[ Follow Ups ] [ Post Followup ] [ Patent Forum ] [ FAQ ] Posted by Ronnie Phillips on February 05, 2001 at 00:33:28: Is it legal to incorporate a patented, off-the-shelf item (that has been legally purchased through normal retail distribution channels) as part of a subsystem in a new invention, or does the new invention have to be a totally new creation before it can be patented? If patentable, is it legal to continue utilizing the patented item in the manufacture of the finished product for retail sale, or would that be considered a patent infringement?
