Dear Andrew,

The protection of games depend on the entire factual situation and the realities of be business world.

A mix of Patent, Trademarks and Copyrights usually can be found to protect a game.

The sucess may be in the marketing. Look at Monopoly. It has survived on its Trademark and Copyright, even though there are competing games that are similar.

Some games are patentable too.
