John, I don't have my statute and regs in front of me, but I agree with you. I recall studying for the pto exam that utility patents issued before June 8, 1995 had a term of 17 years from issue; utility apps filed after June 8, 1995 had a term of 20 years from the earliest effective filing date; and in those situations where the app was pending on June 8, 1995 the term was the longer of either 17 years from issue or 20 years from the earliest effective filing date.
