Posted by Sam Smith on July 25, 2000 at 17:45:29:

In 1998 we came up with a product which we made engineering drawings of and prototyped.
In March of 1999 we began selling our product both retail and wholesale.
We had done patent searches and found no patents that we would infringe.
Having little capital, we decided against patenting it ourselves.
A patent was issued to a person in March of 2000 that is similar to our products design.
That person is now threatening us with a lawsuit charging patent infringement.
Since we had been selling our product since before he even applied for a patent
and have proof of this, can this person really sue us for patent infringement?
Thanks for any adivce.
