Title: Patent Pending (for sale)
Post by RyanJH on Feb 6th, 2006, 3:30pm
I have a patent pending on a way to digitaly use your credit or debit card. This is definantly the only way it can be done with the system we use today. If anybody knows where I can sell this I would appreciate it. I am broke, can't afford a prototype nor a major patent. Please e-mail me if you can help me out. ryanj_h@hotmail.com

What do you mean by "major" patent?

Has the application published?  What's the number?

No, it hasn't been published yet, I've had it since October. The application I sent in is a big mess. I pitched it to an investor once and he told me to brush it up. After I brushed the idea up, he stopped talking to me. I think he's waiting my patent pending out. Palm tried doing something similar to this but there system didn't work with the way debit and credit cards are used in stores. By major patents I mean applying for a non provisional application or getting international protection.

"By major patents I mean applying for a non provisional application"

In other words, you are talking about a provisional application that is not going to be published.

Ryan wrote "I have a patent pending ... If anybody knows where I can sell this I would appreciate it."

The only suggestion I have is the obvious one; develop a marketing approach, contact potential customers, and try to sell it before your provisional application expires.

Actually you probably have to sell it at least a month before the provisional app. expires, so that an experienced patent agent or attorney can rewrite the application.

Actually, if anybody knows an investor willing to sign an NDA and let me pitch them what I have and do a split in royalties with me or pay me a little up front and take 75-80% over me, I would appreciate it. Please reply if anybody can help me out with that.

Thanks...

RyanJH,

Please contact me privately through my website. If you have something, I can help you.

As a general rule, an NDA should not be necessary if you've filed an application for patent. Whatever rights you might have for sale had better be protected by the (eventual) patent or your application isn't worth the time it will take to read. Demanding an NDA as a condition to talk to investors almost always results in a closed door.
