Title: Can I patent a new usage?
Post by Tara on Dec 4th, 2004, 4:05pm
Can I get a patent or some sort of protection for a technology that is used in business inventory control, but I have an idea how to market it toward everyday consumers for other purposes. How do I protect this idea?

Marketing an existing technology to a new market is not in and of itself patentable.

you might want to take a look under the business method.

It's probably true that merely marketing an existing technology to a different market isn't, in and of itself, patentable.  However, the "for other purposes" hints toward the possibility of a non-obvious, new use for existing technology, and that is patentable.

Regards.

An invention can be patented provided you have enhanced the exisiting property of the subject or have made it cost effective.

But most importantly you get your idea copyrigthed so that no one can use it for a period three times larger than the protection available under Patent protection.

Copyright protection is not available for ideas.

Yes, Techincaly speaking idea are not entitled to copyrighed protection but an innovative busiess presentation can get copyrighted for that it has to be first reduced in writing and then this written work can get copyrighted protection. for e.g. business promotion by way of exchange coupens, bonus offers.
