I am concerned we are really not talking about concrete.  For example, it is not possible to enforce a method patent regarding a medical procedure against a doctor, or the facility he works for.
 
So if product A is used in galblator surgery, and now will be used in open heart surgery,  the method patent would not be enforceable against those that would use it.
 
My point:  There are always got yas.
