Can someone provide real life cases (i.e. based on the court verdict)?

I'm not sure what you mean by "passing" but start with KSR v Teleflex: http://www.supremecourtus.gov/opinions/06pdf/04-1350.pdf Also try looking up: Syngenta Seeds Inc. v. Monsanto Leapfrog Enterprices Inc. v. Fisher-Price Omegaflex, Inc. v. ParkerHannifin Frazier v. Layne Christensen Co. Pfizer v. Apotex If you are looking for a recent case where claims were held to not be obvious, try: Takeda Chemical Indus. v. Alphapharm (affirmed non-obviousness)

"Passing" was probably meant to mean "Overcoming"?
