"Three-Peat" - Use in Commerce

When filing for an application one must state its use in commerce.
The uspto.gov site it states:
 
 "Use in commerce" must be a bona fide use of the mark in the ordinary course of trade, and not use simply made to reserve rights in the mark. "
 
My question is how does the "Three-Peat" trademark owned by NBA coach Pat Riley's company -Riles & Co comply with this requirement since as to my understanding, they just seem to be reserving the right to that phrase.
 
Am I off or does Riles and Company legitmately use "Three Peat" in the course of trade?

I don't know the details, but some of the registrations are for marking things like T-shirts and novelty items. Why is it so hard to believe Riley actually set up a company to do that?
