Ownership of programs for data summaries ??

Hi all,

Not quite sure if anyone can help me with my question. First some explanation. Coming from an IT firm, I am currently working as a SAS (statistical analysis program) programmer for a CRO (contract research organization). For people not familiar with this field: a CRO conducts clinical studies to test (new) drugs in human. My job is to develop programs using SAS to list an summarize clinical data coming from the clinical study. Since a CRO is hired by a pharmaceutical company to do the job for them, I am wondering whether my programs are 'owned' by the CRO or the pharmaceutical company ? Especially since one of our clients is now asking to receive all the programs created for his specific study. I am very hesitant to hand the programs. One issue: the pharmaceutical company can do their own programming quite easily for future studies based on these programs, so they would not need a CRO to do it for them anymore. I know that other CROs don't hand their programs either. I have been looking for some law or ruling concerning this, but cannot find any that is specifically for the business I am currently working in. Who can help ?

Thanks !

Disclaimer: I am not an attorney and this does not consitute legal advice.

That said, having worked for many years in software development as a contract developer and/or "consultant", my experience is that what you are asking is a matter which is covered by your contract with your employer, and by your employer's contract with the client.  It is not a question that can be answered without access to those contracts.

You should probably discuss this with your employer.
