I am the inventor of a patent filed by a new company. We are in the national phase. We signed an assignment of intellectual property rights, saying the new company had to pay me by the end of this year and if not, all the "IP rights return to" me. They are clearly unable to pay me, and admit the agreement will soon be in default. I'm now confused. They have the patent, since they filed it, that i know. But since they can't honor the IP agreement, do they lose the rights to profit from the patent, can I market the IP rights without them. Thanks!
