I have an invention that I would like to patent. I have searched the patent database and it is original. I am 15 years old and live in Virginia. Am I allowed to get a patent? Can I sell rights to my invention?

Your age is not a problem regarding applying for or being granted a patent. Regarding selling the rights to the patent: by the time it issues you'll probably be 18, so your age should not be a problem then either. A bigger question is probably - does it make good business sense for you to apply for a patent and do you have the money (about $5000 - $10,000)? Richard Tanzer

Minors (under 18 ) can apply for a patent. The only stipulation is that the minor is required to understand the declaration he/she must sign for the patent application process. Be sure to employ the services of a patent professional if you do go forward. Also be forewarned that just because you did not find your exact invention in the U.S. patent office database does not mean it is patentable. Your invention can (and would likely) be rejected over a combination of references. Additionally, the U.S. patent office database only covers U.S. patents and published patent applications. There may perhaps be foreign patents that speak on the patentability of your invention.
