Topic: taking agent off my invention (Read 554 times) |

I have a pending patent application. I want to remove my current agent. He has not returned a single phone call or email. I am the sole named inventor. Can I do this myself with the USPTO? This guy has had 5 non compliant responses in the past year so I really need someone who knows the ropes. TIA

To withdraw the power of attorney fill out form PTO/SB/82, http://www.uspto.gov/web/forms/sb0082.pdf. If you have hired a new agent or attorney or agent they can fill out the form for you. If you have decided to forego representation, in the portion about your new agent or attorney, just write that you will be handling the case "pro se." Richard Tanzer Patent Agent

Check out this link. http://www.uspto.gov/web/forms/sb0082_fill.pdf If you're going to engage another patent attorney, he could take care of this, too. You're going to want the files in the possession of the other attorney. Without knowing all the details, that's what I'd recommend for now. Note that you have to show you have the power to do this, though.
