Cut and Paste Ok?

I'm writing several provisional applications which have some common elements. For example, about half of the problem statement in the background applies to all of the applications. Some elements of the control strategy provided in one detailed description also applies to more than one application. Assuming that the text isn't otherwise flawed, does anyone see a problem in reusing some text verbatim or with a few changes in terms over two or more applications? tia

I have no problem with that practice - provisional or utility application.

It shouldn't be a problem to have large portions of your applications to be the same as each other. Just be sure that you have some idea what your claims will be and that your provisional applications meet the requirements of 35 USC 112 paragraph 1 relative to those claims.

Isaac - During the next year or so a lot of "experts" will be writing articles and teaching seminars on all the changes in patent practice. I have a feeling that the Festo-related frenzy of about 5 years ago will seem like small potatoes by comparison. - Rich
