Title: How long till you draft a Patent Applications
Post by NewarkNJPatent on Dec 28th, 2006, 4:01pm
I am seeking advice from any experienced patent attorneys.

I have been with a small firm for over a year and half and have not drafted a single application.  My employer keeps telling me that no one drafts an application untill after they have done basis prosecution for at least 3 years.   I feel like I am getting screwed as far as gaining this valuable experience for my future career.  In other words, my employer is purposely making me less marketable by not allowing me to draft a single application.

So look for a new job!

What other response did you expect?

Having to do years of prosecution before drafting is nuts.

I agree with Richard.  I drafted my first application after I had been working for a few months (and part-time at that).  I have been a scientific advisor/patent agent for just over 3 years and have drafted dozens of applications.  I am with Richard, look for a different job.  If your present firm is serious about keeping you, they will change their tune.

Ditto.  I have worked for a few weeks and have already drafted an app!

Day one minute one, my supervising attorney showed me where to sit and handed me an active file and told me to draft the application. He gave me the phone number for the draftsman, said he wanted 20 claims and no more than 10 sheets of drawings.

After he bled all over my first draft the learning began.

Learn by doing......

the real question becomes: what does it take to write a patent application?

answer: only a desire and ability to WRITE!

you certainly don't need to be an attorney - but it helps to be an attorney with both writing and technical skills, a combination that is hard to find

anyway, if you really want to write an application, just do a patent search, then identify an area of need, and prepare an application!
