Title: Masters in Pharmaceutic and Patent agent (future?)

Hi All,

I have done my Masters in Pharmaceutics from DIPS&R (Delhi Institute of Pharmaceutical Sciences and Research, formerely known as College of Pharmacy), Delhi University, India.

I have also cleared the exam of Patent Agent  and currently pursuing LL.B. From Faculty of law, Law Center-1, Delhi University, India.

I am currently working with a leading IPR law firm based in Delhi as a Patent Technologist. Its been about One year experience.

Please advise what is my future in IPR or as a Patent technologist if i look out for foreign countries???????

What are the formalities required to look out for options outside India????

What are the chances in US?????? What are the exams i have to appeared for?????

Will my masters degree, patent agent with experience in India matters???????

What are my chances on finishing Law from here?????

I request you all to please share your views ,guide me and suggest me ways how can i utilizes my resources best in order to move out from India ???

regarding becoming a registered patent agent in the US: you have to pass the patent bar exam by USPTO. Currently the rules to appear for that are very strict for foreign nationals. you have to be working in USA on an H1B visa (unless a permanent resident) and your visa has to be directly related to IP prosecution work.

It indeed has cleared one major doubt,

Can u please advise as patent technologist carrier is better than research scientist or not?? will it pay off in long run????????

I m confused as almost all my colleages are working with leading pharma company as research associate or scientist, should i shift to reseach or not????????

I'd stay in India and work things out there, don't bother coming here because the proficiency required for reading and writing English is in the favor of a native speaker.  . . . .and you'd need to pass the Patent Bar exam here AND already have  a visa, which would be impossible to secure from a law firm since the applicant pool here is already pretty dense with agents with PhD's and the such. . .

Title: Appearing for a patent agent exam on a H1B

Hi,

I have a fulltime Engineering job in Upstate NY and I am on a H1B visa. My greencard process is going on with my spouse and the EAD is expected by Jan\Feb of next year. I'd like to appear for the patent agent exam by USPTO now and start working as a Patent agent as soon as my EAD arrives. Is this a possible action? Can I appear for a patent agent exam while being on H1B and may be provide proof of EAD application?

hi dear here is the same case

i m M.pharm in P`ceutics and 1 year experience as a Patent Analyst in a Pharma Research company in India..

I gave Patent Agent exam and result is awaiting...


I am also in confusion with the career in IP or FnD???

Hi Amrish

It's a common problem which a person like you having a sound background in the field of pharmaceutics and law, face at this stage.

What i suggest, you shld continue working in the law Firm, as soon Indan will be seeing an exponenetial increase in the rate of filing of ligation and opposition cases in the filed of Pharma and other technical fileds by big giants of the likes Pfizer, Glaxo, LG, Novartis etc. as these big names are spending huge amount in their R&D sector and want to secure their technolgy being infringed by others.

At this stage, your expertise in the field of law will be highly advantgaeous for your carrer growth.

I am not able to reconcile why IP professionals from India look out for opportunities in the US. As you would find from the different posts here, the IP job market in the US is already too competitive and your education from a foreign country will definitely put you at a disadvantage in finding a job here. You would be better off in your current jobs. Regarding switching your career, a little introspection would help you to take a decision on your own. Choose the career that best suits your skills and interest.

If your intention is just to land in the US with a job, better learn software programming or become a nurse. If IP practice is your passion, I would sincerely advice you to check out your ability to communicate well in English language. Not intended to hurt anyone, just a thought after reading some of the posts here.

Unless India has changed their drug patent laws to cover compounds and not just processes, I don't see why the pharmas would be increasing their filings there.  The pharmas already patent globally in every worthwhile market, and India's drug patent protection was extraordinarily weak the last I heard.  Has there been a change?
