I have two questions about the patent bar if anybody could be so kind as to answer.

First, in your opinion, is there enough time for me to study and take the exam by the time I start law school on around August 20th (so i'd hope to take the test the weekend before school starts)?  I am working right now as a software tester ~45 hrs a week.  And I guess as a second part to this question, how long does it take to get your application approved once submitted?

Second, I was reading through the application packet and saw that there is a $1600 fee for some.  Who has to pay this fee?  I could not find this when searching through the application or other documents...maybe I am blind.  Anyways if somebody knows the quick answer that would help.

Thanks.  And any advice you have would be appreciated as well.

I can address your first question.  I took a summer, part-time (I was working full-time) to go through the Kayton materials (including all the questions) and attend his workshop.  I passed the August 1998 exam that had a 38% pass rate.  It can be done, but it takes discipline.

Gotta read your MPEP closer!  Before I started this process, I glossed over legal mumbo jumbo liked 37 CFR X.XX....

Well, the general requirements bulletin states you need:

 $40.00 non-refundable application fee as required by 37 CFR § 1.21(a)(1)(i)
-or-
$1600.00 non-refundable fee if required pursuant to 37 CFR § 1.21(a)(10)

What is 37 CFR 1.21 a 10?

(10) On application by a person for recognition
or registration after disbarment or suspension on
ethical grounds, or resignation pending disciplinary
proceedings in any other jurisdiction; on application
by a person for recognition or registration who is
asserting rehabilitation from prior conduct that
resulted in an adverse decision in the Office regarding
the person’s moral character; and on application by a
person for recognition or registration after being convicted
of a felony or crime involving moral turpitude
or breach of fiduciary duty; on petition for reinstatement
by a person excluded or suspended on ethical
grounds, or excluded on consent from practice before
the Office . . . . . . . . . . . . . . . . . . . . . . . $1,600.00


So in a word... probably not you!
