Topic: is patent agent a lawyer? (Read 1136 times) |

I have a friend who is a patent agent but he doesn't have a JD. Can I still call him a lawyer?
In a legal term, does lawyer refer to attorney at law or include a broder group of legal professionals who doesn't necessarily have a JD?

NO
Lawyer (Attorney at Law) refers to a person who is LICENSED to practice law.

Patent Agent is registered to "practice" before the United States Patent and Trademark Office in Patent Cases. Doesn't this make Patent Agent a lawyer for Patent Cases?

No. Lawyer is a term reserved for those licensed by the state to practice law. Even having a JD is not enough to make you a lawyer. Additionally, the current PTO rules require a state attorneys license as a requirement for being registered as a patent attorney and have since about 1959 or so.
