A writing sample can be any technical, legal writing you've
done that shows off the skills you want to showcase.  Patent
applications you've drafted are candidates.  I've used papers
written for engineering award competitions and law school
assignments.

What if you have no writing saved from your career or schooling? (Sad but true.)
 
To top it off, I haven't been to law school, and I have no patent drafting experience.
 
In other words, what should you write for a writing sample, if you have to write it from scratch?

I suggest writing a review article.  Study recent technical and patent literature in the field of your expertise.  Write an article (perhaps 4 - 8 pages long) contrasting and comparing the publications.
