Licensing question
« on: Jul 13th, 2006, 11:12am »

I have an idea for a product (a kit) which will alter the appearance of a basic item. The kit that I plan to offer will consist of components that are readily available and are already licensed (John Deere, Coca Cola among others).

My question is: If my components are already licensed and I am not the end user, will my product need to be licensed as well?

Thanks in advance for any help.

What does the license say?

I'm not sure what you mean. The components of the kit simply say "officially licensed product". The packaging on them doesn't get into specifics. I'm speaking of John Deere and Coca Cola.

The words you are reading indicate that the person who made or sold the components has a license and not that you have one.

Depending on the details of what's in the kit, what you tell the purchasers (directly or impliedly) to do with the kit, and your relationship to the purchasers, you may be indirectly liable for trademark infringement resulting from your purchasers misuse, or you may be directly liable.   Or you may have no liability.

Would the words "Coke Tribute" or "John Deere Tribute" added to the label change anything? I've seen items being sold that are Harley  Davidson Tribute that are black, orange, and have the Harley logo but don't have officially licensed written on them anywhere.

I'm not trying to steal anything from Coke with my product. It's just that I'm taking several products that are readily available and doing the legwork so to speak and making a kit that includes them all. I am manufacturing nothing except the kit itself.

Thanks.
