What if the company never had the employee sign an intellectual property agreement?  Is the employee within rights to ask for compensation before assigning the patent over?

It has been held that future employment is sufficient consideration for assignment of current IP rights.  Beyond that, the EE is always within his rights to "ask" or even demand compensation.  That conduct might occur on his last day of empolyment, however.   Undecided  In addition, there are other ways for an ER to obtain rights, depending upon the job position, reason for hiring, past conduct, and the like.
