Title: Infringement indemnification

I am accustomed to negotiating these provisions in software license agreements(where fees are paid), and finding the middle ground between 1) the licensor being held responsible for all costs and damages, directly or indirectly related, which result from an allegation of infringement; and 2) the licensor not being responsible for any of these costs.

What I see more and more, is licensees insisting on full, unlimited indemnification at the evaluation/trial level. These requests are coming up more and more and I am curious what the experience has been of others and how these issues have been resolved.
