taxation and lisencing

Is there anyone familiar with taxation and lisencing. Obviously, if you sell someone a patent/IP you can claim capital gains.
The issue happens if you are lisencing to someone.
 
I have heard that if you offer non-exclusive lisence, you cannot claim capital gains
However, if you offer exclusive lisence, you can get capital gain
