Assuming a patentable invention, can one use a cofidentiality  agreement to obtain financing and then apply for a patent during the term of the agreement?

Daretodream's response is as dangerous as it is incomplete.  A disclosure to a third party in connection with an attempt to obtain financing will likely be considered a disclosure under 35 U.S.C. § 102(b), and so would start the clock ticking, so to speak, to get to the patent office.

The safer approach always is to file first and disclose second.  In any event, don't rely on a confidentiality agreement to toll the grace period under 35 U.S.C. § 102(b).
