If a web designer transfers copyright of a web site to a new owner, does this mean the designer is legally obligated to provide copies of the data or photoshop files used to build the site (similar to building blocks or pattern of the site) or just the copy of the web site itself?

No it doesn't mean that.  What does the written agreement say will be transfered?

Here is the exact wording of the document I signed:

Assignment of Designer's Copyright in Web Site Material to Owner of Web Site
****xx (the "Designer") is the owner of the copyright in the work commonly known as: ******** web site (the "Work").
For consideration received, Designer irrevocably assigns and transfers to ******** (the "Owner") all rights, title, and interest in and to the copyright in the Work. Owner now has the unlimited and unrestricted right to reproduce the Work, to distribute the Work, to create derivative materials based on the Work, to publicly display the Work, to publicly perform the Work, and to transmit the Work digitally or by any other means.

Upon reasonable request by Owner, Designer agrees to execute any additional documents that may be required to confirm this Assignment and to establish Owner's ownership of the copyright in the Work.


Here is what the terms and conditions state on my site, which her lawyer read, " Design Service owns copyright to the finished web design site produced by Web Design Service until the site is fully paid for. The client will be assigned copyright to the web site once final payment under this agreement and any additional charges incurred have been paid. This copyright does not include re-selling privileges of the design or source code for use on another web site. It does not include the intellectual property in the form of .psd, .swi or .fla or any other working files used in the creation of the site."
