Doesn't this sound (no pun intended) like the DJ Danger Mouse-Gray Album episode of 2004?  I recall one legal scholar commenting it might depend upon how recognizable the new recording was.  Some of the Gray was very recognizable and some was not.

Not familiar with the Danger Mouse case other than hearing about the controversy over the Gray Album.

I heard some brief clips as part of an AIPLA presentation and it wasn't bad.  One clip was not recognizable to the untrained (didn't recall either song), but other was.  Thus, the point about recognizability.
