can someone's song title be used as the name of someone else's company and the company owner not be sued?  
 
for example only, song is called "Moonkiller" by Singer.
 
Businessman decides to name his internet company Moonkiller.  
 
Can the copyright holder of the song sue the business man for using the song title as a name?

In most instances, the songwriter cannot prevent such a use.
