VideoTape confiscation at free outdoor concert-NYC

Is it legal for concert venue security to confiscate a videotape at an outdoor free concert and refuse to give it back and tell you it will be destroyed?  Even though only one minute of crowd was taped? How can I get my tape back?
 
Security checked my bag and saw my camera but did not object to me bring in the camera and they did not verbally state that no taping was allowed. For this reason I reasoned it was ok to film crowd.
 
After they confiscated my tape I went outside and saw that they had a small sign on a fence stating " no drinks, no taping". This sign did not state any confiscation warnings. When I went to their website they mention confiscating merchandise if you attempt to sell something but nothing is stated about confiscating videotapes.

Rules and Regulations
 
The New York City Department of Parks & Recreation strictly forbids the sale of beverages, foods and merchandise by unauthorized vendors. Individuals attempting to sell products will be removed from the site and merchandise will be confiscated. Vendors will be subject to a fine by the City of New York. Beer and wine are for on-site consumption only and may not be removed from the concert grounds. The distribution of unauthorized flyers or promotional materials is not permitted.
