slogans - copyrightable?

T-shirts slogans - can they be copyrighted?  If I have an idea for a line of t-shirts that have original slogans I have thought of, is there anyway I can protect these ideas as intellectual property?  I also am looking at putting the slogans on coffee cups, mouse pads, bumper stickers etc.  What can I do?

You may wish to speak to a trademark attorney.  With copyright, I think you're "barking up the wrong tree"

Dear jkhuggins,

I've created numerous t-shirts, stickers, posters, gag-gifts etc. and Ive found it very frustrating to try and protect all of my designs. The big (most popular) ones I send to the copyright office and I have trademarked one slogan that I based a website on. I just found out last week that two companies stole two of my designs. I even had Spencer Gifts go behind my back and have my designs printed by their manufacturers. I do not have the money to invest in trying to fight these larger companies. I would really like to speak with a IP lawyer, if someone could give me some references.

Thanks,

Tim -

I'm up the Turnpike from you a ways, but I'd be happy to speak by telephone.  I handle the sort of situations you describe.

jkhuggins,

From the US Copyright Office's FAQ:

Copyright does not protect names, titles, slogans, or short phrases. In some cases, these things may be protected as trademarks. Contact the U.S. Patent & Trademark Office, 800-786-9199, for further information. However, copyright protection may be available for logo artwork that contains sufficient authorship. In some circumstances, an artistic logo may also be protected as a trademark.
