Can I do this legally?

I am an instructor at a university that is helping some students with a project. Basically, they are putting together a recruiting video for a non-profit student organization. This video would only be shown at recruiting events and would not be produced to be sold. Can they use portions of current songs as background music in the video? I am looking for legal references and your thoughts. Thanks for your help.

If the music is incidental, such that it "just happens to be caught" in the background of scenes and interviews, then it is okay. Otherwise, such as the case of dubbing in background music in production after the fact and thus making it a considerable part of the work, then you do need permission. The motivation (non-profit, recruiting) is not relevant.
