Hockey Paintings

Hi There

I have created some paintings that were originally based on NHL hockey players in the past. I have changed the paintings to be abstract in nature and may or may not imply certain teams or players.  I am wondering if I am in the clear to display, distribute, and possibly sell these paintings. Three samples of these paintings can be found at this URL.

If not... how abstract do I have to get. I have heard that you cant even have the same colors on the uniform but if this is the case would'nt every uniform company supplying pee wee players with blue and white uniforms be sued by the NHL and Toronto Maple Leafs. How far does this really go.

Secondly I am displaying the original paintings of actual players  team uniforms on my website. They are not for sale, rent, or profit in any way. Is this fair use or should I pull them. They can be found here.

Any advice would be appreciated.

Thanks
Cam

Fair Use is the name and logos of licensed items.  You can't claim Fair Use on infringing items even if they are not for sale.  The argument could be made by the big guys that you are hoping to sell them by posting the pictures.

IMHO the abstracts are fine.

However, I'm not a lawyer, nor do I play one on TV.

I am a 'little guy' who has backed down such corporate bullies as Disney Enterprises and Major League Baseball Properties.

I've got a lot about trademark and copyright law on my website:

Explains more about Fair Use.

Dear Cam,

The law may not operate like commonsense, but Tabberone seems there with both.
