The copyright law protect "what has been created" not the idea. Duplicating what has be created is the tort. Using the idea is not covered by the Copyright Statute.

Basically what you seem  say would not be a question of copyright infringement. Other rights may be actionable.
 
Each situation depends on its own fact and law.
 
If it were that simple, there would be no lawyers.

My unrearched view of the situation is that if the observation of the staging was not a violation of the stagers right, such as a trespass, that the restaging by its nature could not be a copyright infringement.  
 
It is possible that there could be other causes of action but not copyright infringement.
