DVD "Extras" - is that considered editor

Does anyone know if the "Extras" part of a DVD would be considered 'Editorial" so as to avoid gaining permission to re-use footage?  
 
My example is Julia Roberts is on the cover of People Magazine, but she's not promoting People, but the article within the mag, right?  Would this apply to DVD 'extras' - which is mostly interviews and shot documentary-style?
