I'd suggest to look over the cases currently before the Supreme Court. The most earth-shaking one currently is a review of the CAFC's standard for establishing obviousness. It may be a bit overwhelming, but I'd love to see a comprehensive analysis as to how an examiner will have to show obviousness (other than the typical, "well, I just think it's obvious") if the CAFC's rule is abandoned and, if so, how one could rebut such a showing, absent a 6- to 7-figure litigation budget. There are a handful of other cases taken up by the Supreme Court. Any one of them would be a great topic for an article, if they haven't been beaten to death in the academic media already. Even the fact that the Supreme Court has taken a sudden and striking (and some say renewed) interest in patent cases would make for an interesting article. Regards.
