I think I shall tell my friend that legal advice probably best - from what I have seen Copyright Law is VERY COMPLICATED...
 
But - how are you supposed to know when a pitcure or whatever is OK to use and you've made every effort to avoid doing anything wrong
 
To use a comparison...
 
If you are driving down a road and there is no speed limit sign - and you get done for speeding.... how are you supposed to know you are speeding and avoid breaking the law when there is no sign.... should we all drive at 30mph to make sure...Huh?
 
So - if there is nothing to identify something as copyright - why is it reasonable that your average bloke on the street is supposed to know all about copyright law....
 
I wonder how they would calculate the financial gain on using "that particular" picture of a desk... it was there to illlustrate a concept of the office environment - nothing more - just a picture of an office/desk.

I understand your frustration, but you are yelling into the wind.  Copyright law IS very complicated, and especially when it involves matters related to revenue generation and business, you need an attorney.  You are making yourself crazy trying to understand in a very short period of time an area of law that takes IP specialists years to reach a level of competency.  You wouldn't try to perform brain surgery on yourself just because you think surgeons are too expensive and you found a diagram on the internet.
 
Regarding the desk picture, what Bill said is true.  People own what they create be it a picture of a desk or a picture of a fashion model plastered in every magazine on a stand.  That you want to use it for free, but can't, and why can't you, is irrelevant.  It is their property so you must pay them to use it or take a picture of a desk yourself.
 
Call an attorney.  Don't worry; be happy!

The default is that creative works are protected by copyright whether marked or not.  Instead of looking for works without marks, you should instead be looking for permission to use the work or for positive evidence that the work is unprotected.
 
To use your analogy, even if you don't see a speed limit sign, you know that you aren't allowed to drive at 120mph on a city street.
