: : This is some of my homework assignment that I'm having problems with. This is NOT a real case.

: : Here's the fake case...
: : A gallery purchased posters from a well known artist. The gallery used a process that literally lifts the ink off the poster and transferres it to canvas, it leaves the poster blank of ink. The gallery has a web site that features the image of the artists work for sale on canvas. The web site also displays a photograph and biography and several excerpts from articles, with reviews of the artist.

: : So that was it... now I need to know these 4 things.

: : I need to Identify the Intellectual property, then the rights associated with the intellectual property and any violations of the interests and rights. Then give a proposed order of action. I'm struggling with this so anyone who understands this could you please help.

: : I'm suppose to answer the questions as though I was the lawyer for the artist.

: The intellectual property is the artist's creation, in its original medium, or at least the one purchased by the gallery--posters. By altering the medium, and selling it as the artist's own work, the gallery is committing fraud. Certainly a canvas painting is worth more than one on a poster. Their whole purpose is to make more money, by deceiving customers. It is unlawful to buy 50 CDs, rip them to MP3, and sell them in digital format, without the expressed written consent of the artist and record companies who authored/recorded the media. Therefore, it is unlawful to do a similar action with artwork.

: I am taking Internet Law at the moment--just a student, do not treat my words as golden, I would further research this before anything.

Dear LP36071A,
I don't want to be responsible for your pass or fail or worst give an answer that the diabolical professor devised and have you fail.

Email me after the exam is taken and I'll give a short answer of what I think. I give the professor credit for being diabolic in question drafting.
