Do I have any intellectual property rights?

About 3 years ago, I started a company which distributes small novelty items. I purchased a few items from an overseas wholeseller and gave the item a name created by my company. The patent application was never submitted due to company problems and the business never really got off the ground due to lack of operating capital.The item was advertised, with the name our company gave it, and also featured on a popular local television program, which received a huge audience response ( I still have the tape). A couple of months ago I noticed that the item was being sold at a local department store, with the same name that my company had given it. I had noticed the item being offered several months after the news program aired, but only the product itself, being called exactly what it was. This company took it a step further and took the name that we were using to sell the product. Since I did not have a patent or copyright, is there any recourse?
