Dear Chris Campbell, If the name you select signifies services or goods, then the name is used as a trademark or service mark and can be registereed as associated with the goods or services to which it appllies. The usual proceedure it to find an Intellectual Property Lawyer that you can trust, so that you can understand the law as applied to the creation. Since the rights a Federal, the import thing is that you deal with an experienced Lawyer. Insofar as patents are concered, the lawyer MUST have a special qualification to practice before the USPTO. The law does not prevent a non lawyer or even and ignorant lawyer from filing necessary papers. The importance is in understanding what you want and how the law effects what you do. An inexperienced, non Intelledtual Property Lawyer may not have the insight to do more that just effect a registration, if that.
