Dear Cyndie,
I seem to recollect that the Register of Copyrights has a memo that says all works prior to about 1923 are in the public domain. Reproducctions of works are registerable. Without taking professional responsibility and without research, I think you are at risk copyiing from a copyrighted publication as you have put it.

I've registered copyrights on reproductions of ancient works that I feel sure would stand up in court if copied.

The whole legality has to be understood and looked into.
